Any breach of these Ballot Rules by an entrant, as determined by IDIL, will result in the disqualification of the entrant.<\/p>\n<p>3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 IDIL reserves the right to add to, amend or waive any of these Ballot Rules from time to time, without prior notice. IDIL also reserves in its absolute discretion, the right to cancel or amend the Ballot in the event of circumstances arising outside of IDIL\u2019s control. Any modification of the Ballot Rules will be effective immediately, and will be notified through <a href=\"https:\/\/www.redbreastwhiskey.com\/en\/thebirdhouse\/\">www.redbreastwhiskey.com\/en\/thebirdhouse<\/a> as soon as possible thereafter.<\/p>\n<p><strong><u>Ballot Purpose<\/u><\/strong><\/p>\n<p>4.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 IDIL is giving members of \u2019The Birdhouse\u2018 the opportunity to purchase one 500ml bottle of Redbreast Dream Cask. IDIL is holding the Ballot to select the members who will be given the opportunity to purchase these bottles at the conclusion of the Ballot.<\/p>\n<p><strong><u>Eligibility<\/u><\/strong><\/p>\n<p>5.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The Ballot is open to members of &#8216;the Birdhouse&#8217; (sign up available at: <a href=\"https:\/\/www.redbreastwhiskey.com\/en\/thebirdhouse\/\">www.redbreastwhiskey.com\/en\/thebirdhouse<\/a>, who are resident in locations where;<\/p>\n<p>5.1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 the Ballot (governed by Irish law in accordance with these Ballot Rules);<\/p>\n<p>5.2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 alcoholic beverage sales; and<\/p>\n<p>5.3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 alcoholic beverage promotion, advertising and sponsorship;<\/p>\n<p>are legal (&#8220;the <strong>Permitted Jurisdictions<\/strong>&#8220;).<\/p>\n<p>6.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Eligible entrants must be at least eighteen years old at the date of entry and must be of legal drinking age in their country of residence.<\/p>\n<p>7.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The following are not eligible to participate in the Ballot:<\/p>\n<p>7.1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 employees of IDIL or any of its affiliates;<\/p>\n<p>7.2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 any persons professionally connected with the Ballot; and<\/p>\n<p>7.3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 government and public officials;<\/p>\n<p>together the &#8220;<strong>Excluded Categories<\/strong>&#8220;.<\/p>\n<p>8.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 In entering the Ballot, entrants confirm that they are eligible to enter the Ballot. IDIL reserves the right to require entrants to provide proof that they are eligible to enter the Ballot. Entrants&#8217; age will be verifiable by birth certificate, passport or driver&#8217;s licence only. Entrants&#8217; residency will be verifiable by utility bill only, issued within the previous six months.<\/p>\n<p>9.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Determination of eligibility is at the sole discretion of IDIL. IDIL reserves the right to disqualify any entrant that does not comply with these Ballot Rules.<\/p>\n<p><strong><u>Bottle of Dream Cask available for purchase by successful entrants<\/u><\/strong><\/p>\n<p>10.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 IDIL is giving members of &#8216;the Birdhouse&#8217; the opportunity to purchase one 500ml bottle of Redbreast Dream Cask \u2018\u2018Zenith Edition\u2019 38 year-old Irish whiskey for a purchase price of \u20ac1,000.00.<\/p>\n<p>11.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 All listed purchase prices are inclusive of Irish VAT.<\/p>\n<p>12.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Shipping of the bottles of Dream Cask to the successful entrants is available only within the Republic of Ireland, Northern Ireland, England, Scotland, Wales, Switzerland, Germany, South Africa, Australia, New Zealand, China, Singapore and Japan. Bottles of Dream Cask purchased for delivery outside Ireland may be subject to import duties and taxes which are levied when the delivery reaches the delivery destination. Purchasers of Dream Cask will be responsible for payment of any such import duties and taxes. Please note that IDIL has no control over these charges and cannot predict their amount. Entrants should contact their local customs office for further information before participating in the Ballot. Please see <a href=\"https:\/\/midletondistillerycollection.com\/terms-and-conditions\/\">https:\/\/midletondistillerycollection.com\/terms-and-conditions\/<\/a> or further detail.<\/p>\n<p><strong><u>How to Enter<\/u><\/strong><\/p>\n<p>15.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 There is no payment required to enter the Ballot, however valid credit\/debit card payment details must be provided at the time of entry. These details will be held by Shopify and at no juncture will IDIL have access to these details other than the last 4 digits to ensure only one entry per person. Payment is only required on the conclusion of the Ballot to those who are successful.<\/p>\n<p>16.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Eligible entrants may enter the Ballot by visiting our website, <a href=\"https:\/\/www.redbreastwhiskey.com\/en\/thebirdhouse\/\">www.redbreastwhiskey.com\/en\/thebirdhouse<\/a> and follow the link provided to register for the Ballot.<\/p>\n<p>17.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 No fee will be charged for entry into the Ballot, card details are entered on a \u201cPay Later\u201d basis and successful entrants will be offered a separate link upon selection to make payment for the product. Entrants will however be required to:<\/p>\n<p>17.1.\u00a0\u00a0\u00a0\u00a0\u00a0 follow the link provided to the entry page where the entrant\u2019s shopping basket has been pre-populated to hold one bottle of Dream Cask \u2018Zenith\u2019 edition;<\/p>\n<p>17.2.\u00a0\u00a0\u00a0\u00a0\u00a0 enter all required information, including credit\/debit card payment details, for the avoidance of doubt no monies will be deducted at this juncture;<\/p>\n<p>17.3.\u00a0\u00a0\u00a0\u00a0\u00a0 submit their \u2018order\u2019, which, for the avoidance of doubt, shall not constitute a\u00a0\u00a0 purchase at the time of entry but shall constitute an entry for the purposes \u00a0 of the Ballot.\u00a0 If successfully drawn, the entrant\u2019s will be provided with a separate link to re entered their card details to complete the \u2018order\u2019, not later than 28 May 2024.<\/p>\n<p>&nbsp;<\/p>\n<p>Successful entrants will receive an email notifying them that they have been drawn and provided with a separate link to enter their credit card details and that their payment will be processed\u00a0 only at this juncture and shipment prepared.\u00a0 Unsuccessful will be notified on 29 May 2024 that they have not been drawn in the Ballot.<\/p>\n<p>Entrants acknowledge that their personal information, including payment details, will be retained by IDIL\u2019s integrated payment portal Shopify until such time as the Ballot has been drawn.<\/p>\n<p>18.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 By entering the Ballot eligible entrants agree that if successfully drawn, the order of the Dream Cask bottle shall be completed using the payment details provided at entry.\u00a0 If the order is not completed for any reason (whether within the control of IDIL or otherwise), the successful entrant\u2019s opportunity to purchase shall lapse immediately.<\/p>\n<p>19.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Eligible entrants may enter once only and only one payment card may be used for the Ballot (for the avoidance of doubt, any entries from other named individuals using the same card details will not be recognised as eligible entries).<\/p>\n<p>20.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Entry to the Ballot will open on <strong>Monday<\/strong> <strong>20 May 2024<\/strong> at <strong>12.00pm<\/strong> Irish Saving Time (<strong>IST<\/strong>) and will close on <strong>Friday\u00a024 May 2024<\/strong> at <strong>12.00pm<\/strong> IST. Entries received outside this time, or which are incomplete, will not be considered.<\/p>\n<p>21.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 There is no requirement for entrants to &#8216;follow&#8217; or &#8216;like&#8217; IDIL on social media to enter the Ballot.<\/p>\n<p><strong><u>Selection of Winners<\/u><\/strong><\/p>\n<p>22.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Successful entrants will be randomly selected out of all valid entries received. The selection will take place in the presence of an independent observer on <strong>Monday 27 May 2024 at 12.00pm IST<\/strong>.<\/p>\n<p>23.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Entries may be subject to a review at any time for eligibility and compliance with these Ballot Rules.<\/p>\n<p>24.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The successful entrants shall be the individuals who submitted the selected entries. Entries cannot be made on behalf of another person.<\/p>\n<p>25.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 IDIL is not responsible for:<\/p>\n<p>25.1.\u00a0\u00a0\u00a0\u00a0\u00a0 late, incomplete, or misdirected entries, responses, or other correspondence; or<\/p>\n<p>25.2.\u00a0\u00a0\u00a0\u00a0\u00a0 phone, electrical, network, computer, hardware, software program or transmission\u00a0\u00a0 malfunctions, failures or difficulties.<\/p>\n<p>26.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Successful entrants will be notified by email on<strong> 27 May 2024 at 12pm IST<\/strong>(unsuccessful entrants will be notified shortly thereafter).<\/p>\n<p>27.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 If any of the successful entrant\u2019s entry is invalid, ineligible or in breach of these Ballot Rules, the successful entrant\u2019s opportunity to purchase the bottle of Dream Cask will be forfeited.<\/p>\n<p>28.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 By taking part in the Ballot, entrants agree to sign any documentation as may be requested by IDIL relating to the Ballot including, but not limited to, \u00a0a waiver of liability release in favour of IDIL and such other persons as may be determined by IDIL.<\/p>\n<p>29.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 IDIL does not accept any responsibility if the selected entrant is not able to take up the opportunity to purchase the bottle of Dream Cask.<\/p>\n<p><strong><u>Purchase of Dream Cask<\/u><\/strong><\/p>\n<p>30.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Successful entrants will be contacted in accordance with these Rules and the purchase price shall be paid by credit\/debit card and through the purchase platform only. Successful Entrants with have 48 hours to make their purchase, failure to do so will render their selection void and an alternative Entrant shall be randomly selected. In this instance second round winners will be notified on the 29 May 2024 at 4pm IST and will have 48 hours to make their purchase. If a successful second round Entrant fails to make their purchase within 48 hours, their selection will be rendered void and a third round winner will be randomly selected and notified on 4 June 2024 at 12pm IST and will have 48 hours thereafter to make their purchase. Personal data collected for the Ballot will only be used for administration of the Ballot, which includes post-Ballot publicity for successful entrants, and will be deleted immediately thereafter. Such personal data will be processed in accordance with IDIL&#8217;s Privacy Policy (available at <a href=\"https:\/\/www.irishdistillers.ie\/privacy-policy\/\">https:\/\/www.irishdistillers.ie\/privacy-policy\/<\/a><u>)<\/u> and any other privacy policy notified during the entry process (including <a href=\"https:\/\/www.shopify.com\/legal\/privacy\">https:\/\/www.shopify.com\/legal\/privacy<\/a>) in accordance with applicable data protection laws. Personal data previously provided by entrants when becoming members of &#8220;the Birdhouse&#8221; will be continue to be processed for the purposes described in the Privacy Policy.<\/p>\n<p>34.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Because of the international nature of the Ballot, the personal data that you submit with your entry may, subject to applicable law, be transferred internationally to other entities of the Pernod Ricard Group in order to administer the Ballot. IDIL may transfer information that entrants send to IDIL including, without limitation, personal data, to countries that do not provide the same level of legal data protection as the country in which an entrant resides and from which that entrant provided his or her entry. IDIL will carry out any such transfer in accordance with applicable data privacy laws.<\/p>\n<p>35.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Entrants have several rights in relation to their personal data. Entrants have a right to:<\/p>\n<ul>\n<li>access a copy of their personal data held by IDIL;<\/li>\n<li>request rectification of their personal data if it is inaccurate or incomplete;<\/li>\n<li>request erasure of their personal data in certain circumstances;<\/li>\n<li>restrict our use of their personal data in certain circumstances;<\/li>\n<li>move (or port) personal data which is automated in certain circumstances;<\/li>\n<li>object to the processing of their data where our legal basis for processing their data is our legitimate interests;<\/li>\n<li>not to be subject to a decision based on automated processing including profiling which has legal or similar significant effects; and<\/li>\n<li>lodge a complaint with the Office of the Data Protection Commissioner (if an entrant is unhappy with how their personal data is being handled).<\/li>\n<\/ul>\n<p>36.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 If entrants have any queries, they should please contact <a href=\"mailto:idpr-privacy@pernod-ricard.com\">idpr-privacy@pernod-ricard.com<\/a>.<\/p>\n<p><strong><u>\u00a0<\/u><\/strong><\/p>\n<p><strong><u>Other provisions:<\/u><\/strong><\/p>\n<p>37.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 IDIL is committed to compliance with all applicable laws, regulations, policies and ethics rules. These Ballot Rules are intended to ensure that entrants will not violate any such laws, regulations, policies or rules. IDIL seeks no promises or favouritism for itself or any of its affiliates in exchange for an entrant&#8217;s participation in the Ballot.
