Ballot Rules
The Promoter
1. The promoter of the Redbreast Dream Cask (“Dream Cask”) ballot (the “Ballot”) is Irish Distillers International Limited of Simmonscourt House, Simmonscourt Road, Ballsbridge, Dublin 4, Ireland (“IDIL”) These ballot rules set out the terms and conditions governing the Ballot (the “Ballot Rules“).
Ballot Rules
2. By taking part in the Ballot, entrants confirm their full and unconditional agreement to and acceptance of these Ballot Rules. Any breach of these Ballot Rules by an entrant, as determined by IDIL, will result in the disqualification of the entrant.
3. IDIL reserves the right to add to, amend or waive any of these Ballot Rules from time to time, without prior notice. IDIL also reserves in its absolute discretion, the right to cancel or amend the Ballot in the event of circumstances arising outside of IDIL’s control. Any modification of the Ballot Rules will be effective immediately, and will be notified through www.redbreastwhiskey.com/en/thebirdhouse as soon as possible thereafter.
Ballot Purpose
4. IDIL is giving members of ’The Birdhouse‘ the opportunity to purchase one 500ml bottle of Redbreast Dream Cask. IDIL is holding the Ballot to select the members who will be given the opportunity to purchase these bottles at the conclusion of the Ballot.
Eligibility
5. The Ballot is open to members of ‘the Birdhouse’ (sign up available at: www.redbreastwhiskey.com/en/thebirdhouse, who are resident in locations where;
5.1. the Ballot (governed by Irish law in accordance with these Ballot Rules);
5.2. alcoholic beverage sales; and
5.3. alcoholic beverage promotion, advertising and sponsorship;
are legal (“the Permitted Jurisdictions“).
6. Eligible entrants must be at least eighteen years old at the date of entry and must be of legal drinking age in their country of residence.
7. The following are not eligible to participate in the Ballot:
7.1. employees of IDIL or any of its affiliates;
7.2. any persons professionally connected with the Ballot; and
7.3. government and public officials;
together the “Excluded Categories“.
8. In entering the Ballot, entrants confirm that they are eligible to enter the Ballot. IDIL reserves the right to require entrants to provide proof that they are eligible to enter the Ballot. Entrants’ age will be verifiable by birth certificate, passport or driver’s licence only. Entrants’ residency will be verifiable by utility bill only, issued within the previous six months.
9. Determination of eligibility is at the sole discretion of IDIL. IDIL reserves the right to disqualify any entrant that does not comply with these Ballot Rules.
Bottle of Dream Cask available for purchase by successful entrants
10. IDIL is giving members of ‘the Birdhouse’ the opportunity to purchase one 500ml bottle of Redbreast Dream Cask ‘‘Zenith Edition’ 38 year-old Irish whiskey for a purchase price of €1,000.00.
11. All listed purchase prices are inclusive of Irish VAT.
12. Shipping of the bottles of Dream Cask to the successful entrants is available only within the Republic of Ireland, Northern Ireland, England, Scotland, Wales, Switzerland, Germany, South Africa, Australia, New Zealand, China, Singapore and Japan. Bottles of Dream Cask purchased for delivery outside Ireland may be subject to import duties and taxes which are levied when the delivery reaches the delivery destination. Purchasers of Dream Cask will be responsible for payment of any such import duties and taxes. Please note that IDIL has no control over these charges and cannot predict their amount. Entrants should contact their local customs office for further information before participating in the Ballot. 13. The opportunity to purchase a bottle of Dream Cask is non-transferable and there is no cash alternative.
14. Successful entrants must pay all other costs associated with the Ballot which are not specifically included in the purchase price, including the delivery charges and insurance. Please see https://midletondistillerycollection.com/terms-and-conditions/ or further detail.
How to Enter
15. There is no payment required to enter the Ballot, however valid credit/debit card payment details must be provided at the time of entry. These details will be held by Shopify and at no juncture will IDIL have access to these details other than the last 4 digits to ensure only one entry per person. Payment is only required on the conclusion of the Ballot to those who are successful.
16. Eligible entrants may enter the Ballot by visiting our website, www.redbreastwhiskey.com/en/thebirdhouse and follow the link provided to register for the Ballot.
17. No fee will be charged for entry into the Ballot, card details are entered on a “Pay Later” basis and successful entrants will be offered a separate link upon selection to make payment for the product. Entrants will however be required to:
17.1. follow the link provided to the entry page where the entrant’s shopping basket has been pre-populated to hold one bottle of Dream Cask ‘Zenith’ edition;
17.2. enter all required information, including credit/debit card payment details, for the avoidance of doubt no monies will be deducted at this juncture;
17.3. submit their ‘order’, which, for the avoidance of doubt, shall not constitute a purchase at the time of entry but shall constitute an entry for the purposes of the Ballot. If successfully drawn, the entrant’s will be provided with a separate link to re entered their card details to complete the ‘order’, not later than 28 May 2024.
Successful entrants will receive an email notifying them that they have been drawn and provided with a separate link to enter their credit card details and that their payment will be processed only at this juncture and shipment prepared. Unsuccessful will be notified on 29 May 2024 that they have not been drawn in the Ballot.
Entrants acknowledge that their personal information, including payment details, will be retained by IDIL’s integrated payment portal Shopify until such time as the Ballot has been drawn.
18. By entering the Ballot eligible entrants agree that if successfully drawn, the order of the Dream Cask bottle shall be completed using the payment details provided at entry. If the order is not completed for any reason (whether within the control of IDIL or otherwise), the successful entrant’s opportunity to purchase shall lapse immediately.
19. Eligible entrants may enter once only and only one payment card may be used for the Ballot (for the avoidance of doubt, any entries from other named individuals using the same card details will not be recognised as eligible entries).
20. Entry to the Ballot will open on Monday 20 May 2024 at 12.00pm Irish Saving Time (IST) and will close on Friday 24 May 2024 at 12.00pm IST. Entries received outside this time, or which are incomplete, will not be considered.
21. There is no requirement for entrants to ‘follow’ or ‘like’ IDIL on social media to enter the Ballot.
Selection of Winners
22. Successful entrants will be randomly selected out of all valid entries received. The selection will take place in the presence of an independent observer on Monday 27 May 2024 at 12.00pm IST.
23. Entries may be subject to a review at any time for eligibility and compliance with these Ballot Rules.
24. The successful entrants shall be the individuals who submitted the selected entries. Entries cannot be made on behalf of another person.
25. IDIL is not responsible for:
25.1. late, incomplete, or misdirected entries, responses, or other correspondence; or
25.2. phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties.
26. Successful entrants will be notified by email on 27 May 2024 at 12pm IST(unsuccessful entrants will be notified shortly thereafter).
27. If any of the successful entrant’s entry is invalid, ineligible or in breach of these Ballot Rules, the successful entrant’s opportunity to purchase the bottle of Dream Cask will be forfeited.
28. By taking part in the Ballot, entrants agree to sign any documentation as may be requested by IDIL relating to the Ballot including, but not limited to, a waiver of liability release in favour of IDIL and such other persons as may be determined by IDIL.
29. IDIL does not accept any responsibility if the selected entrant is not able to take up the opportunity to purchase the bottle of Dream Cask.
Purchase of Dream Cask
30. Successful entrants will be contacted in accordance with these Rules and the purchase price shall be paid by credit/debit card and through the purchase platform only. Successful Entrants with have 48 hours to make their purchase, failure to do so will render their selection void and an alternative Entrant shall be randomly selected. In this instance second round winners will be notified on the 29 May 2024 at 4pm IST and will have 48 hours to make their purchase. If a successful second round Entrant fails to make their purchase within 48 hours, their selection will be rendered void and a third round winner will be randomly selected and notified on 4 June 2024 at 12pm IST and will have 48 hours thereafter to make their purchase. The link for the ballot will expire in its totality for all entrants on 12pm 6 June 2024.
31. Bottles of Dream Cask purchased for delivery outside Ireland may be subject to import duties and taxes which are levied when the delivery reaches the delivery destination. Purchasers of Dream Cask will be responsible for payment of any such import duties and taxes. Please note that IDIL has no control over these charges and cannot predict their amount. Data Protection:
33. For the purposes of data protection laws, IDIL is the data controller of personal data provided when entering into the Ballot. Personal data collected for the Ballot will only be used for administration of the Ballot, which includes post-Ballot publicity for successful entrants, and will be deleted immediately thereafter. Such personal data will be processed in accordance with IDIL’s Privacy Policy (available at https://www.irishdistillers.ie/privacy-policy/) and any other privacy policy notified during the entry process (including https://www.shopify.com/legal/privacy) in accordance with applicable data protection laws. Personal data previously provided by entrants when becoming members of “the Birdhouse” will be continue to be processed for the purposes described in the Privacy Policy.
34. Because of the international nature of the Ballot, the personal data that you submit with your entry may, subject to applicable law, be transferred internationally to other entities of the Pernod Ricard Group in order to administer the Ballot. IDIL may transfer information that entrants send to IDIL including, without limitation, personal data, to countries that do not provide the same level of legal data protection as the country in which an entrant resides and from which that entrant provided his or her entry. IDIL will carry out any such transfer in accordance with applicable data privacy laws.
35. Entrants have several rights in relation to their personal data. Entrants have a right to:
- access a copy of their personal data held by IDIL;
- request rectification of their personal data if it is inaccurate or incomplete;
- request erasure of their personal data in certain circumstances;
- restrict our use of their personal data in certain circumstances;
- move (or port) personal data which is automated in certain circumstances;
- object to the processing of their data where our legal basis for processing their data is our legitimate interests;
- not to be subject to a decision based on automated processing including profiling which has legal or similar significant effects; and
- lodge a complaint with the Office of the Data Protection Commissioner (if an entrant is unhappy with how their personal data is being handled).

Other provisions:
37. IDIL is committed to compliance with all applicable laws, regulations, policies and ethics rules. These Ballot Rules are intended to ensure that entrants will not violate any such laws, regulations, policies or rules. IDIL seeks no promises or favouritism for itself or any of its affiliates in exchange for an entrant’s participation in the Ballot. By entering the Ballot each entrant:
37.1. Must be over the age of 18 or the relevant drinking age of their home country;
37.2. confirms that they are eligible to do so;
37.3. confirms that they are resident in a Permitted Jurisdiction;
37.4. confirms that they are not employed or otherwise come within one of the Excluded Categories;
37.5. agrees that their participation in the Ballot, including their purchase of any bottle of Dream Cask, will not violate any relevant law, regulation, policy or rule; and
37.6. certifies that any potential purchase, or opportunity to purchase, any bottle of Dream Cask is not in exchange for an agreement to influence a recent, pending or anticipated act or decision that may result in IDIL or any of its affiliates obtaining or retaining business or a business advantage.

39. The Ballot and these Ballot Rules are governed by Irish law and any disputes will be subject to the exclusive jurisdiction of the courts of Ireland.
40. IDIL’s decision in respect of all matters to do with the Ballot will be final and binding.
